Claims against SWISS

SWISS is a Swiss airline, so the regulation covers all SWISS flights from Switzerland and the EU and SWISS flights from non-EU countries (e.g. New York → Zurich). With connecting flights on one booking, what counts is the delay at the final destination; distance runs from the first departure to the final destination. Some LX flights are operated by other airlines (e.g. Helvetic Airways). Claim from the operating airline (Art. 2(b)).

How it works

  1. Check for free: enter route, airline and what happened. The checker works out distance, amount and legal basis.
  2. Letter pack for CHF 9.90: a claim letter with the articles, amount and payment deadline as a PDF and as text for the airline's online form, plus a follow-up letter if the airline rejects or ignores you, and the documents for the free complaint to FOCA (BAZL). In English, German or French.
  3. Keep 100%: the airline pays straight into your account. No commission, no subscription.

FAQ

Does SWISS pay for a 3-hour delay?

Under CJEU case law (Sturgeon) yes, unless there were extraordinary circumstances. FOCA notes these rulings are not binding on Swiss courts but are an important guide to interpretation.

How much compensation can I get?

It depends on the great-circle distance: €250 up to 1,500 km, €400 for 1,500–3,500 km (and for all flights over 1,500 km within the EU/EEA/Switzerland), €600 above 3,500 km. Under certain conditions the amount is halved (Art. 7(2)).

What does the letter pack cost?

The eligibility check is free. The letter pack (claim letter, follow-up letter, FOCA complaint documents) costs CHF 9.90 once, VAT included. No commission: you keep 100% of the compensation.
