EuroAirport: Swiss or French sector?

EuroAirport Basel-Mulhouse-Freiburg is on French territory and is run jointly under the Franco-Swiss treaty of 4 July 1949 (SR 0.748.131.934.92), with a Swiss and a French sector. For your claim this makes no difference: a departure from BSL/MLH is within scope and the regulation applies to every airline.

It can matter for the complaint body. The French DGAC is competent for departures from airports in France and accepts online complaints once the airline has not answered satisfactorily within 2 months. FOCA forwards cases outside its competence to the right body. If in doubt, file with FOCA and mention EuroAirport. Our letter pack includes a note on this.

FAQ

Does the regulation apply at EuroAirport?

Yes, for every departure from Basel-Mulhouse, whatever the sector or airline.

How long do I have?

The regulation sets no deadline. It depends on national law and the competent court. In France it is 5 years. Still, claim as soon as possible.

How much compensation can I get?

It depends on the great-circle distance: €250 up to 1,500 km, €400 for 1,500–3,500 km (and for all flights over 1,500 km within the EU/EEA/Switzerland), €600 above 3,500 km. Under certain conditions the amount is halved (Art. 7(2)).

What does the letter pack cost?

The eligibility check is free. The letter pack (claim letter, follow-up letter, FOCA complaint documents) costs CHF 9.90 once, VAT included. No commission: you keep 100% of the compensation.
