FAQ

Does EU Regulation 261/2004 apply in Switzerland?

Yes. Switzerland adopted the regulation through the Swiss-EU Air Transport Agreement (SR 0.748.127.192.68). It covers every flight departing from Switzerland, the EU, Iceland or Norway, and flights from a non-EU country into them if the operating airline is from one of these countries.

How much compensation can I get?

It depends on the great-circle distance: €250 up to 1,500 km, €400 for 1,500–3,500 km (and for all flights over 1,500 km within the EU/EEA/Switzerland), €600 above 3,500 km. Under certain conditions the amount is halved (Art. 7(2)).

What does the letter pack cost?

The eligibility check is free. The letter pack (claim letter, follow-up letter, FOCA complaint documents) costs CHF 9.90 once, VAT included. No commission: you keep 100% of the compensation.

Why not use a claims agency?

Agencies do the work but often keep around 25–35% of your compensation. The Swiss Federal Office of Civil Aviation (FOCA/BAZL) points out that passengers can assert their rights themselves without representation. With a well-reasoned letter it usually takes 10 minutes.

Is this legal advice?

No. Swissfix Flug is a drafting aid based on the regulation and FOCA guidance. Whether a claim exists in your case is ultimately decided by the airline or a court.
